    End User License Agreement

    Effective 1 September 2026 · Last updated 10 October 2026

    Related: Privacy · Safety & Fair Use

    This Agreement is between you and the individual developer who publishes Journey Cam ("the Developer", "we", "us"). By installing or using Journey Cam ("the App") you accept it in full. If you do not accept it, do not install or use the App.

    Read section 3 before you use the App. It sets conditions on how the App may be used. Using it outside those conditions is a breach of this Agreement and is entirely at your own risk.

    1. License

    You are granted a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, under the Apple Media Services Terms and the standard Apple Licensed Application End User License Agreement, which apply in addition to this Agreement. You may not copy, modify, reverse-engineer, decompile, resell, rent, sublicense, or redistribute the App, except where that restriction cannot lawfully be imposed.

    2. What the App is, and what it is not

    The App is a recording tool. It captures video from your device's cameras — one at a time, or the front and rear together in a single picture — and draws sensor readings such as speed, coordinates, direction, altitude and time onto the recorded frames.

    The App is not proof of anything. It is not a measuring instrument, not a safety device, not a certified recorder, not a source of evidence, not an assistance system of any kind, and not a substitute for attention, judgment, or professional advice. It does not watch where you are going, detect anything, warn you of anything, or intervene in any way.

    Every displayed value comes from your device's own sensors and inherits their error, drift, latency, and outright failure. Nothing the App displays, records, or exports is guaranteed to be true, complete, correct, timely, or fit for any purpose. Where a sensor has no reading the App shows a placeholder rather than a number, but the presence of a number is not a representation that it is correct.

    The App does not monitor your device's temperature, battery, or condition, and takes no responsibility for managing any of them. Those are matters between you, your device, and its operating system.

    Never rely on the App in an emergency. It is not an emergency, rescue, medical, security, navigation, or safety-critical system, has no ability to summon help, and must not be used or depended upon where failure could contribute to harm. If you need help, use the proper emergency services.

    3. Conditions of use, and what is yours

    What the license is for. The App is a personal recording tool. The license is granted for your own lawful, personal use — recording your own journeys, trips, rides and outings, on a device you own, for yourself. Recreational recording of that kind is what the App is designed and supplied for, and the license extends no further.

    What the license is not for. The App is not designed, tested, certified, or supplied for any professional, commercial, official, regulatory, evidential, investigative, monitoring, surveillance, security, or safety-critical purpose, and no suitability for any of those is represented or implied. If you use it for anything of that kind, you do so on your own assessment, at your own risk, and outside anything the Developer has undertaken.

    Legitimate use only. You must use the App lawfully and legitimately, and you must comply with everything that applies to you, wherever you are. Any use that is unlawful, that infringes or harms anyone's rights, or that anything applying to you prohibits, falls outside this license entirely, is a breach of this Agreement, and terminates the license immediately under section 12.

    These are conditions of your license, not advice. Using the App otherwise is a breach of this Agreement, terminates your license immediately under section 12, and is done entirely at your own risk.

    Conditions on using the App:

    • You must not interact with the App in any way while you are moving. That includes touching, holding, viewing, adjusting or attending to it — however you are travelling, by any means, on any surface, in any setting, and it applies with the most force while you are driving or riding a vehicle of any kind. Interacting with the App while you are moving can cause a collision resulting in serious injury or death. That the App can be used while travelling is not permission to operate it while travelling.
    • You must use the App only when it is safe to do so, for you and for everyone around you. Whether it is safe is yours alone to judge, and in any doubt you must not use it. This condition stands in addition to the one above, never as an alternative to it.
    • You must not let the App or the device distract you or anyone else, at any time.
    • You must not rely on the App for anything, and you must not let its presence, its readings, or a belief that it is recording influence how you travel.

    Everything else is yours, and the Developer offers no guidance on any of it.

    How you travel, how and where you place your device, whether that is safe, and everything that applies to you — of any kind, from any source, anywhere — is yours alone. Finding out what applies to you is your obligation. Complying with it is your obligation.

    Checking is your obligation, and it is a continuing one. That includes, without limitation, checking every rule, requirement, restriction, permission, approval, prohibition and enforcement measure that applies where you are, and every manual, instruction, specification, warning and condition issued for whatever you are travelling in or on, for your equipment, your mount and your device — before you use the App, and again whenever anything changes. Requirements differ from place to place and from person to person, and they change. Not knowing is not an excuse you may raise against the Developer.

    Recording is part of this. What may be recorded, where, when, and by whom is not the same everywhere: it differs between countries and between places within a country, it can depend on where you are and what you are pointing at, sound is often treated differently from picture, and it changes over time. Whether you may record at all in a given place, what or whom you may record, and everything you do with the result afterwards, is yours alone to establish and yours alone to comply with.

    The Developer gives no instructions about any of this and has assessed none of it. This is a simple recording tool. It knows nothing about your circumstances, your equipment, or the rules where you are, and it makes no representation that the App, any mount, or any placement is suitable, permitted, or safe for you. Using the App does not reduce, replace, or alter any obligation you already have.

    Anything that binds you outranks this App. If anything the App shows, or anything written here, conflicts with something that applies to you from any other source, follow the other source. The App is never the authority.

    You accept that a device used while travelling can distract, obstruct, overheat, discharge, come loose, or fail, and that the consequences are yours alone.

    4. No reliance, and assumption of risk

    You accept all risk arising from your use of the App.

    You will not rely on the App, or on anything it displays or records, for any purpose where error, absence, delay, or inaccuracy could cause loss, injury, or disadvantage. Any decision you take on the basis of the App's output — and any use you make of a recording, including in a dispute, a complaint, a claim, or any proceeding — is yours alone, taken in full knowledge that the App offers no assurance whatsoever as to accuracy or completeness.

    You further accept that a recording may fail to start, fail to save, stop early, be truncated, be deleted automatically, or be lost entirely — through interruption, storage exhaustion, thermal conditions, the operating system ending the App, a defect in the App itself, or any other reason within or outside the Developer's control. The App is not a backup service and makes no promise to preserve anything. Keeping your own copies of anything that matters is your responsibility alone.

    5. No support

    The App is made by one person. There is no support obligation of any kind: no helpdesk, no guaranteed response, no bug-fix commitment, no update commitment, and no promise that the App will remain available, remain compatible with future versions of iOS or future devices, or work at all. Any assistance given is a courtesy and creates no obligation and no course of dealing.

    6. No warranty

    The App is provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by law, the Developer disclaims all warranties, conditions, and representations, express, implied, statutory, or otherwise, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy, reliability, availability, uninterrupted or error-free operation, quiet enjoyment, and non-infringement. No advice or information, oral or written, obtained from the Developer or through the App creates any warranty.

    7. Limitation of liability

    You use the App entirely at your own risk.

    To the maximum extent permitted by law, the Developer is not liable to you or to any other person for any loss, damage, injury, cost, or expense whatsoever arising out of or connected with the App, your use of it, your inability to use it, or anything recorded with it — whether in contract, tort (including negligence), breach of statutory duty, product liability, statute, or otherwise, whether direct or indirect, whether foreseeable or not, and whether or not the Developer was advised of the possibility.

    This exclusion covers, without limiting its generality:

    • personal injury or death to you or to anyone else, however caused;
    • any incident, collision, or loss of control of any kind, however caused — including where distraction, obstruction, a device coming loose, or attention given to the App is said to have played any part;
    • damage to anyone's property, of any kind;
    • any claim brought against you by a third party, and any liability you incur to anyone else, arising in any way from the App or from what you recorded;
    • loss, corruption, truncation, or absence of recordings, in whole or in part, for any reason including storage exhaustion, automatic deletion, interruption, thermal shutdown, operating-system termination, or software defect;
    • a recording that failed to start, failed to save, stopped early, or captured nothing;
    • any malfunction, defect, error, freeze, crash, or unexpected behavior of the App, whether or not it was foreseeable and whether or not it has been reported;
    • deletion of a recording by any automatic process in the App, including loop rotation, storage limits, and age-based clean-up, however configured and whether or not the configuration was understood;
    • overheating, thermal throttling, battery drain, battery degradation, reduced device lifespan, or any other effect of prolonged recording or of charging while recording;
    • inaccurate, missing, delayed, or misleading sensor readings of any kind;
    • any consequence of any kind of your use of, or reliance on, the App or anything it produced, including any proceeding or dispute in which a recording is used, disputed, or found wanting;
    • anything you failed to comply with, from any source, and any consequence of the App, a mount, or a device being unsuitable or not permitted in your circumstances;
    • any direct, indirect, incidental, special, consequential, exemplary, or punitive loss, and any loss of profit, revenue, data, goodwill, or opportunity.

    Nothing in this Agreement makes the Developer responsible for your acts, your omissions, or your negligence, or for those of any other person. How you drive, how you mount your device, how you behave in a vehicle, and what you do with a recording are yours alone. If your conduct causes loss or injury to anyone, that is between you and them, and section 8 applies.

    Where liability cannot lawfully be excluded, the Developer's total aggregate liability for all claims combined is limited to the amount you actually paid for the App, if anything.

    That limit is a ceiling on liability. It is not a refund entitlement and does not create one. Refunds are handled solely by Apple under the App Store refund policy in force at the time; the Developer cannot issue, approve, expedite, or influence a refund, and nothing in this Agreement obliges the Developer to pay you anything.

    8. Indemnity

    To the maximum extent permitted by law, you will indemnify, defend, and hold the Developer harmless against any claim, demand, action, proceeding, loss, liability, damages, or expense (including reasonable legal costs) brought or incurred by anyone and arising from: your use of the App; anything you record, keep, publish, or share; any incident occurring while the App was in use or installed in your vehicle; your breach of this Agreement, including the conditions in section 3; or your breach of any law or of anyone's rights.

    9. Third parties

    Except as stated in section 14, nobody other than you and the Developer acquires any right under this Agreement. No other person — including anyone travelling with you and anyone appearing in your recordings — has any claim against the Developer arising from the App, and you are solely responsible for anything owed to them.

    10. Your responsibilities

    You are solely responsible for:

    • Using the App only as section 3 permits.
    • Checking, and then complying with, everything that applies to you — every law, rule, requirement, restriction, permission, approval, prohibition, enforcement measure, manual, instruction, specification, warning, condition, agreement, and policy, of any kind, from any source, wherever you are, whether it concerns how you travel, the equipment you use, the device, the mount, or what you may record. Working out what applies to you is your obligation, and it continues for as long as you use the App. The Developer neither knows nor assesses any of it, and not knowing is not an excuse you may raise against the Developer.
    • What you record, where and when you record it, and everything that appears in it. What may be recorded is not the same everywhere and can change; establishing what applies where you are, before you record, is yours alone, as is complying with it. That covers, without limitation, any person, voice, property, land, premises, installation, place or situation where recording is controlled, restricted, or prohibited, and everything you do with a recording afterwards. Recordings stay on your device unless you export or share them, and the Developer never sees them and cannot review, approve, restrict, or remove anything you record. Answering any complaint or claim about a recording of yours is yours alone. This includes that an exported video carries your coordinates in the picture.
    • Your own copies. The App preserves nothing and promises nothing.

    11. Purchases

    Any purchases or subscriptions, and their prices, are shown on the App Store and handled by Apple under Apple's terms; we never see your payment details. Restore Purchases re-grants a purchase on the same Apple ID. Refunds are governed entirely by Apple's App Store refund policy and are requested from Apple, not from us.

    12. Changes and termination

    The Developer may, at any time, without notice, without giving reasons, and without liability of any kind: update the App; change, disable, or remove any feature, including one you rely on or purchased; stop developing it; stop supporting it; withdraw it from sale; remove it from the App Store entirely; discontinue it permanently; or sell, assign, or transfer the App, this Agreement, and any rights or obligations under it to any other person, who may then do all of the same things.

    None of that entitles you to any notice, refund, compensation, replacement, migration, or continued access. The App may stop working at any time — including as a result of an operating-system update, a change by Apple, a device you replace, or the App being withdrawn — and the Developer has no obligation to restore it, to keep it compatible with anything, or to make it available again.

    Your copy already installed will keep working for as long as it happens to, and no longer. Export anything you care about while you can.

    We may update this Agreement; a new version is presented in the App and requires your acceptance before continued use. This license ends automatically if you breach this Agreement, including the conditions in section 3, and you may end it at any time by deleting the App. Sections 2, 3, 4, 6, 7, 8, 9, and 14 survive termination.

    13. General

    Governing law and jurisdiction. This Agreement is governed by the laws of Belgium, and the courts of Belgium have non-exclusive jurisdiction over any dispute arising from it.

    If you are a consumer, this does not take anything away from you. You keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in your own country's courts. Nothing here is intended to prevent that.

    Age and capacity. You must be old enough to enter into a binding contract where you live in order to accept this Agreement and use the App. If you are not, a parent or legal guardian must accept it on your behalf and is responsible for your use of the App.

    Your own costs. Any mobile data, storage, electricity, battery wear, device wear, mounts, or accessories involved in using the App are yours to pay for and yours to replace.

    Feedback. If you send the Developer any suggestion, idea, bug report, or other feedback, the Developer may use it for any purpose, without restriction, without attribution, and without owing you anything. Sending feedback creates no obligation to reply, to act on it, or to keep it confidential.

    Events outside anyone's control. The Developer is not liable for any failure or delay caused by anything beyond its reasonable control, including changes made by Apple or to iOS, network or infrastructure failure, device failure, or any act of authority.

    Time limit for claims. To the extent the law where you live permits it, any claim arising out of or relating to the App or this Agreement must be brought within one year of the event giving rise to it, or it is permanently barred.

    Severability. If any provision is held unenforceable, it is severed and the rest stands with the fullest effect the law allows. Where an exclusion is unenforceable where you live, it applies as far as that place permits, and the other exclusions are unaffected.

    Waiver and entire agreement. Failing to enforce a provision is not a waiver of it. This Agreement, together with Apple's terms, is the entire agreement between you and the Developer about the App.

    What cannot be excluded. A small number of things cannot be contracted away by anyone, anywhere — in most countries, death or personal injury caused by the Developer's own negligence, and fraud. This Agreement does not attempt to exclude those, because attempting it would put the rest of the exclusions at risk of being struck down with it.

    To be completely clear: that says nothing about your negligence. It concerns only the Developer's own conduct. Nothing in this Agreement makes the Developer answerable for anything you do, fail to do, or do carelessly, or for the conduct of anyone else. Your statutory rights as a consumer where you live also apply regardless of anything said above.

    14. Apple

    This section is required by Apple and applies in addition to everything above. Where it conflicts with anything else in this Agreement, this section prevails.

    • This Agreement is between you and the Developer only, not with Apple. Apple is not responsible for the App or its content, and is not a party to this Agreement.
    • Scope of license. The license granted in section 1 is non-transferable and is limited to use of the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions — except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
    • Maintenance and support. The Developer alone is responsible for any maintenance and support for the App, to the extent required by applicable law. As stated in section 5, there is none. Apple has no obligation whatsoever to provide any maintenance or support for the App.
    • Warranty. The Developer alone is responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind in respect of the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are the Developer's sole responsibility.
    • Product claims. The Developer, not Apple, is responsible for addressing any claim by you or any third party relating to the App or to your possession or use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation. Nothing in this Agreement limits the Developer's liability to you beyond what applicable law permits.
    • Intellectual property. If a third party claims that the App or your possession and use of it infringes their intellectual property rights, the Developer, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
    • Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
    • Developer contact. Questions, complaints, and claims about the App should be directed to: Lucanise — mail.lucanise@gmail.com. Contacting the Developer creates no support obligation; see section 5.
    • Third-party terms. You must comply with any applicable third-party terms of agreement when using the App.
    • Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of it Apple has the right — and is deemed to have accepted the right — to enforce this Agreement against you as a third-party beneficiary.
