Penpage — End User Licence Agreement

Penpage is made by Giuseppe Lucariello, Belgium ("I", "me"). By using the app, you agree to this. If you don't agree, don't use it.

1. This is between you and me

This agreement is between you and me only — not with Apple. I'm responsible for Penpage and its content, not Apple. Apple has no obligation to provide any maintenance or support for it.

2. What you can do with it

You get a personal, non-transferable licence to use Penpage on Apple devices you own or control, under the Usage Rules in Apple's Media Services Terms. Don't sell it, rent it, redistribute it, or try to reverse-engineer it, except where the law says you may.

3. What Penpage is — and isn't

Penpage draws short text you type as animated handwriting and exports it as a video or image. It's a rendering tool, not storage. Nothing you type is saved, backed up, or sent anywhere. Your text lives in memory while the screen is open and is gone when you leave it. Don't put anything in Penpage that you can't afford to lose.

4. Your words are your responsibility

You're responsible for everything you type, export, save, publish or share with Penpage, and for whatever comes of it. You confirm you have the right to use that content. Penpage doesn't provide, check, moderate or verify any text — it only draws what you type.

Don't use Penpage for anything unlawful, infringing, defamatory, harassing, hateful, obscene, fraudulent, or that breaches someone's privacy.

Penpage produces handwriting-styled images. Don't use it to fake signatures, documents, letters, or evidence, or to pass anything off as genuinely handwritten by someone else. If you do, that's on you, along with any claim that follows.

5. No warranty, no liability

Penpage is provided "as is" and "as available", with no warranties of any kind — express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy or non-infringement. I don't guarantee it will work, keep working, produce any particular result, or stay available.

To the fullest extent the law allows, all liability is excluded. I'm not liable for any loss or damage of any kind arising from your use of, or inability to use, Penpage — including lost or unrecoverable text, failed or imperfect exports, device or data problems, or any direct, indirect, incidental or consequential damages, whether or not I was warned they were possible.

You use Penpage entirely at your own risk. You accept all risks arising from using it and from its nature as a simple tool.

6. Money

Any purchases or subscriptions, and their prices, are shown on the App Store and handled by Apple. If you ever pay anything for it or through it, your only remedy is to ask Apple for a refund, subject to Apple's own terms and time limits. Refunds are handled by Apple, not by me — I can't issue one, and I owe you nothing beyond what Apple chooses to refund.

7. I can change or withdraw it at any time

I may change, update, limit, suspend, withdraw, discontinue or transfer Penpage — in whole or in part — at any time, without notice and without liability to you. I may also transfer this agreement along with the app. Because nothing you type is stored, there is nothing to migrate, export or recover, and no notice period applies. Continuing to use the app after a change means you accept it.

8. Support

Any support for Penpage is down to me, and I'm not obliged to provide any. Apple isn't obliged to provide any either.

9. If something doesn't work

If Penpage fails to conform to any applicable warranty, you can tell Apple, and Apple will refund the purchase price, if any. Beyond that refund, Apple has no warranty obligation, and anything else is my responsibility.

10. Claims

I'm responsible, not Apple, for handling any claim about Penpage or your use of it — including product liability, any failure to meet a legal or regulatory requirement, and claims under consumer protection or privacy law. The same goes for any claim that Penpage infringes someone's intellectual property.

11. Where you are

You confirm you're not in a country under U.S. embargo or designated as "terrorist supporting", and that you're not on a U.S. government list of prohibited or restricted parties. You'll also comply with any third-party terms that apply when using the app.

12. Apple can enforce this

Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

13. Privacy

Penpage collects nothing. No network, no account, no analytics, no tracking, no stored content. Full policy: https://lucanise.com/penpage

14. Ending it

This licence ends if you break it, or whenever you delete the app. Sections 4, 5, 6, 7 and 10 survive.

15. Law

Belgian law applies, without affecting the consumer protections you have where you live. If any part of this is unenforceable, that part is severed and everything else still stands.
